		<description>That&#039;s right, Chirnese, and what I&#039;ve seen in hearings is the bankruptcy trustee asking clients if their income has gone up or down.  

Remember that you must answer under oath at the hearing just as your petition is filed under penalty of perjury.  What I tell my clients is that if they have a firm job offer prior to the hearing, even if they have not yet started, then they must answer yes.  

I would never advise a client not to take a job, they need it.  If they get one and have to say yes, if it disqualifes them from a chapter 7 then good for them because they need the income.  

However, I&#039;ve also noticed that with a new job&#039;s responsibilities often comes new expenses such as dry cleaning, commuting to work at a considerable distance, so gas and car tires go up, insurances may need to be increased.  

My favorite is when a client recognizes that once blessed with the job, they can finally go back to paying a 10% tithe again.  

&quot;Will a man (or woman) rob God?&quot; Heck no. If this is a moral/financial obligation you would have paid or did pay when you were earning a living before, then by all means pay it again now.  

If you had an epiphany that leads you to believe that you have that moral obligation to pay it, even if you weren&#039;t before, the bankruptcy code expressly does not stop you from doing it now.  

What they will do is verify it over time moving forwards.  If you said you were and then you didn&#039;t, you could be facing serious penalties.

I have been mislead by my lender Ahmsi in California on Loan modifications and repayment plans. I&#039;m a 55 yr old tribal member cherokee nation living off reservation and currently facing a sale date on my property on 07/20/2011, I have a 9 yr old adopted grand daughter and i&#039;m currently un-employed due to spinal surgeries recently from a hit and run auto accident that forced me to close my contractors business and that is the reason for me being in forclosure .

my lender have run me around making promises on giving me loan modifications and repayment plans for the last year almost and now say they cant due the modification and now im $ 22,000 dollars behind and they wont except a payment from me at all. I filed a chapter 7 in 2006 can i file a chapter 13 , my wife works full time and i have alittle check every month from adoption assistence . we have two cars that i have car title loans on and are current, we have no savings acct, no checking, at all now, no stocks, no bonds, no other property. can you let me know if you can help and i cannot afford at the moment a large downpayment for retainer fees due to medical expenses on my surgeries, and do you have payment plans on chapter 13 filing. I have my certification from credit counceling in hand i need to file an emergency chapter 13 before 07/20/2011 , thank you , jimmy james</description>
